Terms & Conditions

 

By booking and/or participating in any class, session, or event (hereinafter, “Activity”) organized by Central Park Pilates (“Company”), I hereby acknowledge, understand, and agree to the following:

  1. Assumption of Risk
    I understand that participation in physical exercise, including Pilates and related fitness activities, involves inherent risks, including but not limited to physical exertion, muscle strain, sprains, falls, broken bones, or other injuries. I acknowledge that these risks may be increased due to the outdoor nature of the classes, including but not limited to:

    • Uneven terrain, tree roots, dirt, grass, rocks, and other natural elements;

    • Exposure to weather conditions such as heat, cold, wind, or rain;

    • Interaction with insects, animals, allergens, or other environmental irritants;

    • Tripping hazards including but not limited to sticks, branches, park furniture, or equipment.

  2. Medical Disclaimer
    I certify that I am physically fit and have no medical condition that would prevent my safe participation in the Activity. I understand that Central Park Pilates does not provide medical advice or emergency medical services and that I am solely responsible for monitoring my own physical condition during the class.

  3. Release and Waiver of Liability
    In consideration for being permitted to participate in the Activity, I voluntarily agree to release, waive, and discharge Central Park Pilates, its instructors, contractors, employees, agents, and affiliates (collectively, “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any injury, illness, damage, loss, or emotional distress that I may suffer as a result of participation in the Activity, whether caused by negligence of the Released Parties or otherwise, and including any incidents occurring before, during, or after the class, whether on-site or en route.

  4. Indemnification
    I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, damages, costs, and attorney’s fees arising from my participation in the Activity or from any breach of this agreement.

  5. Photography & Media Release
    I grant Central Park Pilates the right to use any photographs or videos taken during the class for promotional purposes, unless I explicitly notify the Company in writing prior to the class.

  6. Governing Law
    This agreement shall be governed by and construed in accordance with the laws of the State of New York. Any legal action arising under this agreement shall be brought exclusively in a court of competent jurisdiction located in New York County, NY.

BY BOOKING A CLASS THROUGH THIS WEBSITE, I ACKNOWLEDGE THAT I HAVE READ THIS LIABILITY WAIVER, FULLY UNDERSTAND ITS TERMS, AND AGREE TO BE LEGALLY BOUND BY IT.

Liability Waiver and Assumption of Risk

This website is owned and operated by Central Park Pilates (“we”, “us”, “our”). These Terms and Conditions (“Terms”) set forth the legally binding agreement under which you may use our website and services. By accessing or using our website and/or purchasing or booking any services, you confirm that you have read, understood, and agree to be bound by these Terms.

1. Use of Website and Services

This website offers visitors the ability to purchase and schedule Pilates classes held in outdoor public spaces, such as Central Park in New York City. These classes involve physical exercise and may take place on natural terrain.

To use our website and/or receive our services, you must be at least 18 years old (or the age of legal majority in your jurisdiction), and have the legal authority to enter into these Terms as a binding agreement. You may not use the website or our services if such use is prohibited under any applicable law or regulation.

2. Bookings, Cancellations & Refunds

2.1 Booking and Payment

When you book a class, you agree that:

  • You are responsible for reviewing the class description and schedule prior to booking.

  • You enter into a legally binding contract when you complete the booking and payment process.

  • Payments are due at the time of booking and are processed securely through our third-party payment processor.

 

2.2 Cancellation and Rescheduling Policy

  • You may cancel or reschedule a class at least 48 hours before the scheduled start time to receive a full refund or credit.

  • Cancellations made within 48 hours of the class start time will not be eligible for a refund but may be rescheduled.

  • If a class is cancelled by us due to weather or other uncontrollable events, you will receive a full refund if a reschedule cannot be arranged.

 

3. Outdoor Risks and Assumption of Liability

By participating in our outdoor classes, you acknowledge that these activities involve inherent risks including, but not limited to:

  • Uneven ground, tree roots, dirt, rocks, or other natural elements;

  • Environmental factors such as heat, rain, wind, insects, or allergens;

  • Personal injury or property loss due to physical activity performed in a public setting.

By booking a class through this website, you assume all risks associated with participation and agree to hold Central Park Pilates LLC harmless from any injury, illness, emotional distress, or property damage incurred during the class or on the premises.

 

4. Intellectual Property

All content on this website—including text, images, logos, videos, and graphics—is the sole property of Central Park Pilates. You may not copy, distribute, modify, or create derivative works from any part of this website without our prior written consent.

 

5. Changes to Services

We reserve the right to modify or discontinue any part of the services offered through this website at any time without notice or liability. This includes changes to pricing, schedules, or class availability.

 

6. User Conduct and Account Termination

We may suspend or terminate your access to the website or any booked services if, in our sole discretion, you violate these Terms or engage in any misuse or unlawful activity. You may discontinue your use of the website at any time by ceasing all activity and deleting your account, if applicable.

 

7. Limitation of Liability

To the maximum extent permitted by applicable law, Central Park Pilates shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, injury, or emotional distress, arising from use of the website or participation in any class.

 

8. Indemnification

You agree to indemnify and hold harmless Central Park Pilates from and against any and all claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the website or participation in classes, or from your breach of these Terms.

 

9. Promotional Communications

By providing your contact information, you agree to receive occasional promotional emails or messages from us. You may opt out of these communications at any time by contacting us or clicking the unsubscribe link provided in our emails.

 

10. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be effective upon posting to the website, and continued use of our website or services after such changes constitutes your acceptance of the revised Terms.

 

11. Governing Law and Jurisdiction

These Terms shall be governed exclusively by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the courts located in New York County, New York.
